[B]cpd25 - Employment Law for University Librarians
Tuesday 30 January 2007 Birkbeck College Main Building, Room 629[/B] http://www.bbk.ac.uk/bbk/maps.html A one day seminar/workshop for senior and operational Library managers focussing on key elements of employment law and best practice relevant to their day to day management responsibilities. The training will be instructive, interactive and entertaining. Participants will be asked to complete a short pre-training questionnaire to ascertain current levels of knowledge and areas of interest and concern. Trainer Dermot Scully is a senior member of JSB's Employment Law Faculty, a practising solicitor specialising in employment law and Joint Head of the Employment Group at Harbottle & Lewis LLP. He regularly trains and presents to a wide variety of JSB clients and has written many articles on a range of employment law issues. Programme 9.15 Coffee and registration 9.30 Introductions Discrimination - Sex, race and disability discrimination - Direct and indirect discrimination - Genuine occupational qualifications - Harassment and bullying - Making reasonable adjustments - Age discrimination - Sexual Orientation - Maternity issues – returning part-time - Flexible working requests - Work and Families Act 2006 - Equality Act 2006 11.00 Coffee 11.15 Grievance and Disciplinary Procedures - Difference between a ‘grievance’ and a disciplinary matter - Dealing with a grievance - Conducting a disciplinary hearing - Rules of natural justice - Rights of a companion and postponement - Suspending an employee - Acting reasonably 12.30 Lunch 13.30 Dismissal (including Absence Control) - Acting reasonably - ‘Wrongful’ and ‘Unfair’ - Constructive dismissal - Employee’s statutory rights - Qualifying period and excluded employees - Written reasons for dismissal Dealing with: - Poor performance - ‘Dishonesty’ outside the workplace - Misuse of email and internet - Absence management - Employer’s obligations - Short and long-term absence - Failure to return and ‘frustration’ - ‘Capability’ aspects - Absence and fair dismissals - Stress-related absence - Understanding ‘reasonableness’ 15.00 Tea 15.15 Case Study - This case study will deal with key aspects of this programme. - Participants will consider the legal and practical issues arising from a particular scenario, and how such matters should be dealt with so that litigation is avoided. The precise programme content will vary depending upon the priorities and needs of the participants and changes in the law between now and the date of the seminar.
